Health & Safety Disclaimer and Release of Liability

Club Haven refers to Courtney Cooke, an individual doing business as “Club Haven” (a Massachusetts sole proprietorship), together with any instructors, employees, or contractors working with or for Club Haven (collectively, “Club Haven,” “we,” “us,” or “our”).

By joining Club Haven, you’re agreeing that: you’re choosing to participate in chair yoga, Pilates, Qi Gong, meditation, Yoga Nidra, and related content at your own risk; Club Haven’s content is not medical or mental health advice and doesn’t replace your doctor or therapist; you’re responsible for your own space and safety when practicing at home; and you’re releasing Club Haven from claims arising from the ordinary risks of these activities, to the extent the law allows. Please read the full document below before accepting.
1. Acceptance of These Terms
By checking the acceptance box and clicking “I Agree & Join” (or equivalent) during registration, you confirm that you have read, understood, and voluntarily agree to this entire Health & Safety Disclaimer and Release of Liability (“Agreement”). This is a legally binding agreement. If you do not agree, do not check the box, and do not join or use any Club Haven content or services.
This Agreement applies to all Club Haven offerings, including live and on-demand chair yoga, Pilates, and Qi Gong classes; meditation, Yoga Nidra, and guided relaxation content; wellness tips and articles; and any other class, video, audio, or written content Club Haven makes available now or in the future (collectively, the “Services”).
2. Eligibility
You must be at least 18 years old to create a Club Haven membership and agree to this Agreement on your own behalf. Club Haven’s Services are not directed at or designed for children.
3. Health & Medical Disclaimer
Club Haven is a wellness and movement resource. It is not a medical provider, and nothing in the Services is medical advice, a medical diagnosis, psychotherapy, or a substitute for care from a qualified physician, physical therapist, or mental health professional.

Always talk with your physician before starting chair yoga, Pilates, Qi Gong, or any new movement practice, particularly if you are pregnant, are recovering from surgery or injury, or have any heart condition, joint condition, balance concern, high or low blood pressure, respiratory condition, or other condition that could be affected by physical activity.

If you have a heart condition, have had a stroke, experience chest pain, dizziness, or shortness of breath with exertion, or have been advised by a doctor to limit physical activity, please get your physician’s clearance before participating, and let them know the type and intensity of movement you plan to do.

Meditation, Yoga Nidra, and guided relaxation practices can occasionally bring up strong emotions or difficult memories. These practices are not a treatment for anxiety, depression, trauma, or any other mental health condition. If you are currently working with a therapist or psychiatrist, it’s worth mentioning that you’re adding these practices, particularly if you have a trauma history.

If you are experiencing a medical emergency, call 911 (or your local emergency number) immediately. Club Haven has no way to see, hear, or respond to you during on-demand or pre-recorded content, and cannot monitor your condition during any class.

If you are having thoughts of harming yourself, please call or text 988 (Suicide & Crisis Lifeline, U.S.) or go to your nearest emergency room. Club Haven’s content is not equipped to respond to a mental health crisis.
Providing any health-related information to Club Haven does not create a doctor-patient or therapist-client relationship with Club Haven.
4. Nature of the Activities and Inherent Risks
Chair yoga, Pilates, Qi Gong, and related movement practices — even when gentle and low-impact — carry inherent physical risks, including but not limited to: muscle strain, sprain, or soreness; joint pain or injury; loss of balance or falls; dizziness or lightheadedness; and, rarely, more serious cardiovascular events. Meditation and Yoga Nidra carry inherent emotional/psychological risks, including the surfacing of difficult emotions or memories.
Because most Club Haven content is accessed at home or in another location you choose, you — not Club Haven — control that environment. You are solely responsible for:

Choosing a safe, clear space with enough room to move, a sturdy chair with no wheels or arms that could shift or tip, and a stable, non-slip floor surface;

Removing or avoiding obstacles, cords, pets, or other hazards in your practice area;

Using equipment (chairs, mats, props) that is in good condition and appropriate for the activity;

Stopping immediately if you feel pain, dizziness, chest discomfort, or shortness of breath, and seeking medical attention if needed;

Modifying or skipping any movement that doesn’t feel right for your body — Club Haven’s cues are general guidance, not a personalized medical or fitness prescription, and instructors cannot see or correct your individual form in on-demand content.
5. Assumption of Risk
By participating in any Club Haven class, video, or program, you voluntarily and knowingly assume all risks of injury, illness, or harm — physical, emotional, or otherwise — that may result from your participation, whether arising from your own actions, the actions of others, the condition of your practice space or equipment, or the design or content of the Services themselves, known or unknown, foreseen or unforeseen.
This assumption of risk applies whether you are a beginner or experienced practitioner, and whether you are participating in a live class, an on-demand video, or reading written wellness content.
6. Release and Waiver of Liability
To the fullest extent permitted by applicable law, you release, waive, and discharge Club Haven from any and all claims, demands, causes of action, or liability for any injury, illness, death, or property damage that you may suffer arising out of or in any way connected with your participation in the Services, including claims based on Club Haven’s ordinary negligence.
This release does not apply to, and Club Haven does not seek to disclaim, liability for gross negligence, recklessness, or intentional misconduct, to the extent such liability cannot be waived under applicable law. Nothing in this Agreement waives any right or protection that cannot lawfully be waived in your state of residence.
If you reside in a state where a release of this kind is limited or unenforceable for a particular type of claim (for example, some states restrict or prohibit liability waivers for recreation or health-club services), this Section 6 applies only to the extent your state’s law permits, and the rest of this Agreement — including your assumption of risk under Section 5 — remains in full effect.
7. Indemnification
You agree to indemnify and hold harmless Club Haven from any third-party claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of this Agreement, your misuse of the Services, or your violation of any law or the rights of a third party — except to the extent such claims result from Club Haven’s own gross negligence, recklessness, or intentional misconduct.
8. No Guarantee of Results
Wellness outcomes are individual. Club Haven makes no guarantee, warranty, or promise — express or implied — regarding any specific physical, mental, or emotional result from using the Services, including any level of flexibility, strength, stress reduction, or symptom improvement. Testimonials and success stories reflect individual experiences and are not a guarantee of your results.
9. Third-Party Content, Links, and Products
Club Haven may reference or link to third-party websites, products, apps, or professionals (for example, a recommended physician directory or a props supplier). Club Haven does not control and is not responsible for third-party content, products, or services, and a mention or link is not an endorsement or a guarantee.
10. Limitation of Liability
To the fullest extent permitted by applicable law, and except where prohibited, in no event will Club Haven’s total liability to you for any claim arising out of or relating to the Services exceed the amount you paid Club Haven in the twelve (12) months before the claim arose. Club Haven is not liable for indirect, incidental, consequential, or punitive damages, even if advised of the possibility of such damages. This limitation does not apply to liability that cannot be limited under applicable law.
11. Governing Law and Venue
This Agreement is governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where a member’s home state’s consumer-protection or recreation-liability laws mandate otherwise for that member. Any legal action arising out of this Agreement will be brought in the state or federal courts located in Middlesex County, Massachusetts.
12. Severability
If any provision of this Agreement is found unenforceable or invalid by a court, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
13. Entire Agreement; Changes
This Agreement, together with Club Haven’s Terms of Service and Privacy Policy, is the entire agreement between you and Club Haven regarding health and safety matters and supersedes any prior understanding on this subject.
Club Haven may update this Agreement from time to time; if we make material changes, we will notify you (for example, by email or in-app notice) and, where required by law, ask you to re-accept before you continue using the Services.
14. Electronic Signature
By clicking “I Agree & Join,” you are providing your electronic signature and agreeing that it has the same legal effect as a handwritten signature, consistent with the U.S. ESIGN Act and your state’s Uniform Electronic Transactions Act.
