Welcome to Club Haven. These Terms of Service (“Terms”) govern your use of the Club Haven website, digital content, membership services, and related offerings (collectively, the “Services”).
Club Haven is operated by Courtney Cooke, doing business as Club Haven, based in Massachusetts (“Club Haven,” “we,” “us,” or “our”).
By accessing or using the Services, creating an account, or purchasing or beginning a Club Haven membership or trial, you agree to these Terms. You also agree to our Privacy Policy and Health & Safety Disclaimer and Release of Liability, each of which is incorporated into these Terms by reference.
If you do not agree to these Terms, please do not use the Services.
1. Club Haven Membership
Club Haven provides access to digital wellness content that may include gentle fitness, chair yoga, Pilates-inspired movement, Qigong, guided meditation, Yoga Nidra, relaxation practices, wellness tips, educational materials, and other related content.
Membership features and available content may change from time to time as Club Haven adds, updates, or removes offerings.
Your membership is for your personal, non-commercial use only.
2. Free Trial and Recurring Membership
Club Haven currently offers a 14-day free trial, followed by a recurring membership fee of $19.99 per month, unless otherwise stated at the time you enroll.
By beginning a trial and providing an accepted payment method, you authorize Club Haven and its payment providers to charge the applicable monthly membership fee after the trial period ends and on a recurring monthly basis thereafter unless you cancel.
Before you complete enrollment, the checkout or membership enrollment experience will provide the applicable trial and recurring-payment information, including the date by which you must cancel to avoid being charged and the date your first membership charge will occur.
Your subscription will continue to renew automatically until cancelled.
3. Cancellation
You may cancel your Club Haven membership at any time to prevent future renewal charges.
For memberships purchased online, an online cancellation method will be made available through the Club Haven website, your member account, or another online cancellation mechanism provided as part of your membership experience.
To avoid being charged following a free trial, you must cancel by the cancellation date shown to you when you enroll.
To avoid a future monthly renewal charge, you must cancel before the applicable renewal occurs.
Cancellation stops future recurring charges but does not automatically entitle you to a refund of charges already processed.
4. Refunds
Unless otherwise required by applicable law, membership charges that have already been processed are non-refundable.
If you cancel your membership after a monthly charge has been processed, your cancellation will prevent future renewal charges. Access to membership content may continue through the end of the period already paid for, depending on the functionality of the membership platform.
Club Haven may, in its discretion and where appropriate, issue a refund or credit.
5. Membership Accounts
Certain Services require you to create or use a customer or member account.
You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs through your account.
Membership accounts are intended for individual use. You may not share your login credentials or provide membership access to another person.
You agree to provide accurate and current information when creating or maintaining your account.
6. Members-Only Content
A Club Haven membership provides a limited, personal, non-exclusive, non-transferable right to access the content included with your membership while your membership remains active.
Membership content may be delivered through Club Haven’s website or through third-party platforms or video-hosting services.
Unless Club Haven expressly gives you permission, you may not:
- copy, reproduce, record, download, distribute, republish, sell, or commercially exploit Club Haven content;
- share members-only videos, links, passwords, or access credentials with others;
- publicly display or redistribute membership content;
- modify or create derivative commercial works from Club Haven content; or
- use Club Haven content to operate or support another commercial wellness, fitness, or educational service.
All rights not expressly granted to you remain with Club Haven and its licensors.
7. Health and Wellness Disclaimer
Club Haven provides wellness, fitness, movement, meditation, relaxation, and educational content for general informational and wellness purposes.
Club Haven content is not medical advice and is not a substitute for professional medical diagnosis, treatment, counseling, physical therapy, or other licensed healthcare services.
Participation in physical movement or wellness activities involves inherent risks.
Your use of Club Haven content is subject to the separate Health & Safety Disclaimer and Release of Liability, which you should review before participating.
By using the Services, you acknowledge that you are responsible for determining whether activities are appropriate for you and for seeking appropriate professional advice when necessary.
8. Intellectual Property
The Club Haven name, branding, logos, website content, videos, photographs, graphics, written materials, class concepts, designs, and other original materials are owned by or licensed to Club Haven and are protected by applicable intellectual property laws.
Nothing in these Terms transfers ownership of Club Haven intellectual property to you.
9. Acceptable Use
You agree not to use the Services:
- for unlawful or fraudulent purposes;
- to interfere with or disrupt the website or membership platform;
- to attempt to gain unauthorized access to another member’s account or restricted content;
- to scrape, copy, harvest, or systematically collect content or data from the Services;
- to impersonate another person; or
- in a way that violates these Terms or the rights of Club Haven or another person.
10. Third-Party Services
Club Haven may use third-party providers to operate portions of the Services, including Shopify, membership platforms, payment processors, email providers, analytics services, and video-hosting platforms.
Your use of certain third-party features may also be subject to the applicable provider’s terms and privacy practices.
Club Haven is not responsible for interruptions or failures caused by third-party platforms that are outside Club Haven’s reasonable control.
11. Changes to Membership, Pricing, and Services
Club Haven may update, modify, suspend, or discontinue portions of the Services or membership offering from time to time.
Club Haven may also change membership pricing or billing terms.
Where required by applicable law, Club Haven will provide notice before changes affecting recurring charges or other material membership terms take effect.
12. Suspension or Termination
Club Haven may suspend or terminate access to the Services if you materially violate these Terms, misuse membership content, share unauthorized access, engage in fraudulent activity, or otherwise misuse the Services.
Termination for a violation of these Terms does not waive any rights Club Haven may have under applicable law.
13. Disclaimer of Warranties
To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis.
Club Haven does not guarantee that the Services will always be uninterrupted, error-free, or available at all times, or that any particular wellness, fitness, health, or personal result will be achieved.
Nothing in these Terms excludes warranties or protections that cannot legally be excluded.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Club Haven and its owner, contractors, service providers, and representatives will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Services.
Nothing in these Terms is intended to limit liability that cannot lawfully be limited or excluded.
The separate Health & Safety Disclaimer and Release of Liability contains additional terms relating specifically to participation in Club Haven fitness and wellness activities.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Club Haven and its owner, representatives, and service providers from claims, liabilities, losses, damages, or expenses arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person’s rights.
16. Privacy
Your use of the Services is also governed by the Club Haven Privacy Policy.
Please review the Privacy Policy to understand how personal information may be collected, used, and disclosed.
17. Changes to These Terms
Club Haven may update these Terms from time to time.
When changes are made, the updated Terms will be posted on this website with a revised effective date. Additional notice will be provided when required by law.
Your continued use of the Services after an update becomes effective constitutes acceptance of the updated Terms, except where additional consent is required by law.
18. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.
19. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
20. Entire Agreement
These Terms, together with the Privacy Policy, Health & Safety Disclaimer and Release of Liability, and any membership or checkout disclosures presented when you enroll, constitute the agreement between you and Club Haven concerning your use of the Services.
